The Administrative Measures for Prevention and Treatment of port Acquired Immune
Deficiency Syndrome as adopted at the ministerial meeting of the General Administration of Quality Supervision, Inspection and Quarantine of the People’s Republic of China on May 30, 2007, are hereby promulgated and shall enter into force as of December 1, 2007.

The Administrative Measures for the Prevention and Treatment of Port Acquired immune deficiency syndrome
Chapter Ⅰ: General Provisions
Article 1 The Measures are formulated in order to enhance the prevention and control of Acquired immune deficiency syndrome (hereinafter referred to as AIDS) at the frontier ports and ensure human health and public health at ports in accordance with the Frontier Health and Quarantine Law of the People’s Republic of China and its Implementation regulations and The Regulations on the AIDS Prevention and Treatment.
Article 2 The Measures shall apply to the quarantine, monitoring, epidemic reports and control as well as propaganda, etc.of port AIDS.
Article 3 The General Administration of Quality Supervision, Inspection and Quarantine of the People’s Republic of China (hereinafter referred to as AQSIQ) shall take charge of port AIDS prevention and control throughout the country, be responsible for formulating overall plans,and carry out the organization, coordination and administration of port AIDS prevention and control.
Article 4 The entry-exit inspection and quarantine institution established by AQSIQ at the localities (hereinafter referred to as the inspection and quarantine institution) shall be responsible for formulating work plans to organize, coordinate and administrate port AIDS prevention and control within region under their jurisdictions, and carry out quarantine, monitoring, epidemic reports and control as well as the propaganda thereof.
Article 5 The inspection and quarantine institution shall coordinate with the local government to prevent and control AIDS, establish coordinative systems with all levels of local health administrative departments, diseases prevention and control institutions, public security organs and frontier inspection agencies, ect, and bring the AIDS surveillance at ports in line with the local action plan of AIDS prevention and control so as to port AIDS prevent and control as well as the monitoring of the people living with HIV/AIDS.
Article 6 The inspection and quarantine institution shall strengthen the propaganda on AIDS prevention and treatment at the entry-exit ports, provide specific consultation and guidance to the entry-exit people , and set up consultation line to the public.
Chapter Ⅱ: Quarantine at Ports
Article 7 The inspection and quarantine institution shall strengthen the quarantine, supervision and administration on the entry-exit people, as well as entry-exit microorganism, human body tissues, biological products, blood and its products, etc, (hereinafter referred to as “Special Goods”) .
Article 8 Any entry-exit people living with HIV/AIDS shall make a declaration to the inspection and quarantine institution when in entry, which shall verify the authenticity of the contents of declaration, provide health consultation, and notify the information to the inspection and quarantine institution, the diseases prevention and control departments of destination.

Article 10 The citizens of the People’s Republic of China who apply for departure more than one year or Chinese staffs working on the international conveyances, shall hold the valid health certificates enclosing the results of AIDS test issued by the inspection and quarantine institution or the hospitals at or above the county level.

Chapter Ⅲ: Surveillance at Ports
Article 12 The AQSIQ shall establish and perfect the monitoring networks for port AIDS. The inspection and quarantine institution shall set up monitoring points for port AIDS based on the AIDS epidemic tendency and report to the AQSIQ.
The inspection and quarantine institution shall implement AIDS surveillance in accordance with the relevant norms formulated by the department of public health administration under the State Council and the AQSIQ, and strengthen the AIDS surveillance on the entry-exit target groups according to the changes and tendency of AIDS epidemic situation.
Article 13 The AQSIQ shall designate AIDS screen laboratories and AIDS confirmatory laboratories according to the needs of port AIDS prevention and control. The AIDS screen laboratory and AIDS confirmatory laboratory shall carry out work in compliance with related national provisions of bacterial (viral) strains and laboratory bio-safety.
The laboratories of the inspection and quarantine institution undertaking AIDS testing shall not carry out test relating to HIV antibody, etc. until they meet the standard and norms of the health authority of the State Council and pass examination.
Article 14 The inspection and quarantine institution shall provide consultation and screening test services to those who apply for AIDS consultation and tests voluntarily, If a HIV positive result is found, the sample shall be timely sent to AIDS confirmatory laboratory to verify.
Article 15 The inspection and quarantine institution shall strictly carry out standardized operating procedure, bio-safety management system and disinfection management system to avoid iatrogenic infection of AIDS in accordance with relevant regulations.
Chapter Ⅳ: Epidemic Report and Control
Article 16 When any of the people living with HIV/AIDS is found, the inspection and quarantine institution and their staff shall report epidemic in accordance with relevant provisions of health quarantine information report of entry-exit ports.
Epidemic information shall be reported within 6 hours via the health quarantine information management system.
Article 17 The inspection and quarantine institution shall timely notify the port AIDS epidemic information to the local health administrative department according to the provisions of relevant laws and regulations.
Article 18 The inspection and quarantine institution shall make epidemiological investigation on the people living with HIV/AIDS found, and provide AIDS prevention and control consultation to them. They shall coordinate with the inspection and quarantine institution for investigation and accept medical advice.
Article 19 The entities and individuals under investigation shall provide real information, and shall not conceal or fabricate any information while the inspection and quarantine institution carry out relevant investigations so as to grasp or control the AIDS epidemic.
The inspection and quarantine institution and their staff shall not publicize the relevant information of the people living with HIV/AIDS without the consent of them or their guardians.
Article 20 The inspection and quarantine institution shall seal up, test or sterilize the HIV-polluted suspects. If it is a conformed HIV-polluted article, it shall be subject to hygiene disposal or being destroyed.
Chapter Ⅴ: Measures of Safeguard
Article 21 The funds for the port AIDS prevention and control shall be included in AQSIQ budget. AQSIQ shall set up special funds for AIDS prevention and control, which is to be used for the construction of AIDS laboratories and port AIDS prevention and control.
Article 22 The inspection and quarantine institution shall be responsible for the establishment of the professional teams of port AIDS prevention and control under their jurisdictions, equip them with qualified professionals and conduct professional skill trainings.
Article 23 The funds for AIDS prevention and control shall be guaranteed on the designated purpose. The efficiency of the funds shall be enhanced. Either detainment or misappropriation of the fund shall be prohibited.
Chapter Ⅵ: Legal Liabilities
Article 24 For any entity or individual violating the provisions of the Measures and failing to cooperate with the inspection and quarantine institution in the investigation and control of AIDS epidemic, the inspection and quarantine institution shall order it or him to make correction. If the circumstance is serious, it or him shall be punished according to the Frontier Health and Quarantine Law of the People’s Republic of China and its implementation regulations; if a crime is constituted, it or him shall be subject to criminal liabilities according to law.
Article 25 For any authority of inspection and quarantine failing to fulfill the duties of AIDS prevention and control management, supervision and safeguard, the department at the next higher level shall order it to correct, and circulate a report of criticism according to The Regulations on the AIDS Prevention and Treatment.
Article 26 Any staff member of an inspection and quarantine institution, in violation of the provisions of the Measures, committed any of the following circumstances and caused the transmission or spread of AIDS or other serious consequences, shall be given administrative punishments in accordance with the law by their work units; if a crime is constituted, he shall be subject to criminal liabilities:
1. Failing to perform the duties of monitoring, report, notification or disclosure of AIDS epidemic,or concealing, making false report, delaying or failing to report the AIDS epidemic; or
2. Failing to take timely measures for prevention and control when the AIDS spread or possibly spread; or
3. Failing to perform the duties of supervision and inspection or failing to conduct timely investigation when finding any violation of law; or
4. Failing to conduct relevant AIDS testing according to the technical specifications and requirements; or
5. Intentionally disclosing the relevant information or materials involving the personal privacy of the people living with HIV/AIDS; or
6. Other relevant acts of malpractice or dereliction of duty.
Chapter Ⅶ: Supplementary Rules
Article 27 The power to interpret the Measures shall be vested in AQSIQ.
Article 28 The Measures shall come into force on December 1, 2007. If the previous provisions are inconsitent with the Measures, the latter shall prevail.

口岸艾滋病防治管理办法
第一章 总 则
第一条 为了做好国境口岸艾滋病的预防、控制工作,保障人体健康和口岸公共卫生,依据《中华人民共和国国境卫生检疫法》及其实施细则和《艾滋病防治条例》等法律法规的规定,制定本办法。
第二条 本办法适用于口岸艾滋病的检疫、监测、疫情报告及控制、宣传教育等工作。
第三条 国家质量监督检验检疫总局(以下简称国家质检总局)主管全国口岸艾滋病预防控制工作,负责制定口岸艾滋病预防控制总体规划,对全国口岸艾滋病预防控制工作进行组织、协调和管理。
第四条 国家质检总局设在各地的出入境检验检疫机构(以下简称检验检疫机构)负责制定所辖口岸区域艾滋病预防控制的工作计划,对口岸艾滋病预防控制工作进行组织、协调和管理,实施检疫、监测、疫情报告及控制、开展宣传教育。
第五条 检验检疫机构应当配合当地政府做好艾滋病预防控制工作,与地方各级卫生行政主管部门、疾病预防控制机构、公安机关、边防检查机关等建立协作机制,将口岸监控艾滋病的措施与地方的预防控制行动计划接轨,共同做好口岸艾滋病预防控制及病毒感染者和艾滋病病人的监控工作。
第六条 检验检疫机构应当在出入境口岸加强艾滋病防治的宣传教育工作,对入出境人员有针对性地提供艾滋病防治的咨询和指导,并设立咨询电话,向社会公布。
第二章 口岸检疫
第七条 检验检疫机构应当加强对入出境人员以及入出境微生物、人体组织、生物制品、血液及其制品等物品(以下简称特殊物品)的检疫和监督管理工作。
第八条 患有艾滋病或者感染艾滋病病毒的入出境人员,在入境时应当向检验检疫机构申报,检验检疫机构应当确认申报内容的真实性,并对其进行健康咨询,同时应当通知其目的地的检验检疫机构及疾病预防控制部门。
第九条 在境外居住1年以上的中国公民,入境时应当到检验检疫机构设立的口岸艾滋病监测点进行健康检查或者领取艾滋病检测申请单,1个月内到口岸检验检疫机构或者县级以上的医院进行健康体检。
第十条 申请出境1年以上的中国公民以及在国际通航的交通工具上工作的中国籍员工,应当持有检验检疫机构或者县级以上医院出具的含艾滋病检测结果的有效健康检查证明。
第十一条 申请来华居留的境外人员,应当到检验检疫机构进行健康体检,凭检验检疫机构出具的含艾滋病检测结果的有效健康检查证明到公安机关办理居留手续。
第三章 口岸监测
第十二条 国家质检总局应当建立健全口岸艾滋病监测网络。检验检疫机构根据口岸艾滋病流行趋势,设立口岸艾滋病监测点,并报国家质检总局备案。
检验检疫机构按照国务院卫生行政主管部门和国家质检总局制定的艾滋病监测工作规范,开展艾滋病的监测工作,根据疫情变化情况和流行趋势,加强入出境重点人群的艾滋病监测。
第十三条 国家质检总局根据口岸艾滋病预防控制工作的需要,确定艾滋病筛查实验室和确证实验室。艾滋病筛查和确证实验室应当按照国家菌(毒)种和实验室生物安全管理的有关规定开展工作。
检验检疫机构承担艾滋病检测工作的实验室应当符合国务院卫生主管部门的标准和规范并经验收合格,方可开展艾滋病病毒抗体及相关检测工作。
第十四条 检验检疫机构为自愿接受艾滋病咨询和检测的人员提供咨询和筛查检测,发现艾滋病病毒抗体阳性的,应当及时将样本送艾滋病确证实验室进行确证。
第十五条 检验检疫机构应当按照国家有关规定,严格执行标准操作规程、生物安全管理制度及消毒管理制度,防止艾滋病医源性感染的发生。
第四章 疫情报告及控制
第十六条 检验检疫机构及其工作人员发现艾滋病病毒感染者和艾滋病病人时,应当按照出入境口岸卫生检疫信息报告的相关规定报告疫情。
疫情信息应当在6小时内通过卫生检疫信息管理系统进行报告。
第十七条 检验检疫机构应当按照有关法律法规的规定及时向当地卫生行政部门通报口岸艾滋病疫情信息。
第十八条 检验检疫机构应当对检出的艾滋病病毒感染者、艾滋病病人进行流行病学调查,提供艾滋病防治咨询服务。艾滋病病毒感染者、艾滋病病人应当配合检验检疫机构的调查工作并接受相应的医学指导。
第十九条 检验检疫机构为掌握或者控制艾滋病疫情进行相关调查时,被调查单位和个人必须提供真实信息,不得隐瞒或者编造虚假信息。
未经本人或者其监护人同意,检验检疫机构及其工作人员不得公开艾滋病病毒感染者、艾滋病病人的相关信息。
第二十条 检验检疫机构应当对有证据证明可能被艾滋病病毒污染的物品,进行封存、检验或者消毒。经检验,属于被艾滋病病毒污染的物品,应当进行卫生处理或者予以销毁。
第五章 保障措施
第二十一条 口岸艾滋病预防控制经费由国家质检总局纳入预算,设立检验检疫机构艾滋病防治专项经费项目,用于艾滋病实验室建设及口岸艾滋病的预防控制工作。
第二十二条 检验检疫机构负责所辖口岸艾滋病预防控制专业队伍建设,配备合格的专业人员,开展专业技能的培训。
第二十三条 艾滋病预防控制资金要保证专款专用,提高资金使用效益,严禁截留或者挪作他用。
第六章 法律责任
第二十四条 任何单位和个人违反本办法规定,不配合检验检疫机构进行艾滋病疫情调查和控制的,检验检疫机构应当责令其改正;情节严重的,根据《中华人民共和国国境卫生检疫法》及其实施细则的有关规定予以处罚;构成犯罪的,依法追究刑事责任。
第二十五条 检验检疫机构未依照本办法的规定履行艾滋病预防控制管理和监督保障职责的,根据《艾滋病防治条例》的有关规定,由上级机关责令改正,通报批评。
第二十六条 检验检疫机构工作人员违反本办法规定有下列情形,造成艾滋病传播、流行以及其他严重后果的,由其所在单位依法给予行政处分;构成犯罪的,依法追究刑事责任:
(一)未依法履行艾滋病疫情监测、报告、通报或者公布职责,或者隐瞒、谎报、缓报和漏报艾滋病疫情的;
(二)发生或者可能发生艾滋病传播时未及时采取预防控制措施的;
(三)未依法履行监督检查职责,发现违法行为不及时查处的;
(四)未按照技术规范和要求进行艾滋病病毒相关检测的;
(五)故意泄露艾滋病病毒感染者、艾滋病病人涉及个人隐私的有关信息、资料的;
(六)其他失职、渎职行为。
第七章 附 则
第二十七条 本办法由国家质检总局负责解释。
