AQSIQ announcment on further strengthening administration of import infant formula

 质检总局关于加强进口婴幼儿配方乳粉管理的公告

AQSIQ Announcement No. 133, 2013

For further implement the deployment of the State Council on further strengthening the quality and safety of infant formula，the following requirements are hereby announced:

1. The infant formula mentioned in this announcement referred to infant formula, infant formula for larger infants and children.  

2. Overseas manufacturers exporting infant formula to China shall make registration according to provisions stipulated in the "Administrative Measures on Supervision of Inspection and Quarantine of Import and Export Dairy Products ", the "Administrative Provisions on Registration of Overseas Manufacturers of Import Food Products" and the "Announcement of AQSIQ on Issuing the Implementation Catalogue of Registration of Overseas Manufacturers of Import Food Products". From the date of May 1, 2014, infant formula of overseas manufacturers without registration shall not allowed to be imported into China.

3. In case that the the dates from the date of daclearation for inspection and the date of expiration is less than 3 months, the infant formula shall not be allowed to import.

4. It is strictly forbidden to import big package infant formula for subpackaging in the domestic territory.

5. Fom April 1, 2014, the infant formula labels in Chinese must be printed on the final sale package before entering into China. It shall not be allowed to stick the labels after entering into China. In case that the product has no label in Chinese or the label in Chinese is not in conformity with the laws and regulations and the food safety National Standards of China, the products shall uniformly be dealt with as non-conformity products and shall be returned back or to be destoried.

Except as otherwise noted, all requirements of this announcment shall be implemented from the date of announcement.

婴幼儿配方乳粉管理的公告

2013年第133号

为贯彻落实国务院关于进一步加强婴幼儿乳粉质量安全工作的部署，现就有关要求公告如下。

一、本公告所称婴幼儿配方乳粉指婴儿配方乳粉、较大婴儿和幼儿配方乳粉。

二、对华出口婴幼儿配方乳粉的境外生产企业应按照《进出口乳品检验检疫监督管理办法》（质检总局令第152号）、《进口食品境外生产企业注册管理规定》（质检总局令第145号）及《质检总局关于公布〈进口食品境外生产企业注册实施目录〉的公告》（质检总局公告2013年第62号）的规定，办理注册。自2014年5月1日起，未经注册的境外生产企业的婴幼儿配方乳粉不允许进口。

三、进口婴幼儿配方乳粉，其报检日期到保质期截止日不足3个月的，不予进口。

四、严禁进口大包装婴幼儿配方乳粉到境内分装，进口的婴幼儿配方乳粉必须已罐装在向消费者出售的最小零售包装中。

五、自2014年4月1日起，进口婴幼儿配方乳粉的中文标签必须在入境前已直接印制在最小销售包装上，不得在境内加贴。产品包装上无中文标签或者中文标签不符合中国法律法规和食品安全国家标准的，一律按不合格产品做退货或销毁处理。

除另有说明外，本公告之各项要求自发布之日起实施。
